Subject: SBW non-use of "Incorporated" or "Inc".


  Hi SBW committee,

As you know, Shoalhaven Bushwalkers is an incorporated association in NSW with the registered name "Shoalhaven Bushwalkers Inc." Are you aware that the abbreviation "Inc." only appears once on the entire Shoalhaven Bushwalkers website? It's in the Acknowledgement of Country.

The Department of Fair Trading website at www.fairtrading.nsw.gov.au/associations-and-co-operatives/associations/starting-an-association/naming-your-incorporated-association under the heading of "Where does our name have to appear" says -

"The full name of the association including the word 'Incorporated' or the initials 'Inc.' must appear in legible characters on official documents, including all business letters, statements, invoices, receipts, notices and publications (including the association's website) in connection with its activities."

I am not sure that one instance on the club's website actually complies with this requirement. I'm also not sure whether "business letters" includes emails, but I would think that it does. If so, no recent emails from Shoalhaven Bushwalkers on club business include any reference to "Incorporated" or "Inc.". In the good old days when the President, Secretary, Treasurer and Webmaster all had their own email addresses and sent out official emails from the club, they all had signatures at the bottom of each email that included "Shoalhaven Bushwalkers Inc."

In addition, I checked the latest Ettremist - a club publication - and it does not include "Shoalhaven Bushwalkers Incorporated" or "Shoalhaven Bushwalkers Inc." anywhere.

You might want to look into the legalities of not using "Incorporated" or "Inc." when it is a legal requirement ... ??
